Data Handling and Protection:

Intended Purpose
Personal data is handled and processed by our company for the purpose of starting employment and to fulfill contractual commitments. All categories of data relevant for the fulfillment of precontractual and contractual obligations are affected. Personal data is only transferred to third parties if this is necessary to fulfill the business purpose. Personal data is not transferred to third parties and to third countries with an unclear level of data protection (normally countries outside of the EU), which are not part of the fulfillment of the business purpose, or only if the persons concerned have given their consent.


The collection, the processing and the usage of personal data is carried out to the extent legally permitted according to article 5 and 6 DSGVO. When personal data of persons concerned is collected, the persons concerned have the right to transparent information according to article 12 ff DSGVO and pursuant to § 32 BDSG. Generally only information is processed and used, that is necessary for performing operational duties and is directly related to the processing purpose. Special requirements for collecting, processing and using particular categories of personal data according to article 9 DSGVO pursuant § 22 ff BDSG are considered.


The special requirements for the collection, processing and use of special categories of personal data pursuant to Art. 9 DSGVO and § 22 ff BDSG are observed. According to the DSGVO, the processing and handling of sensitive data is only permitted under the principle of the reservation of permission or upon submission of a legal basis.

 


The rights of the person concerned
According to Art. 15 ff DSGVO, the persons concerned have the right to information, correction, deletion, restriction and objection to the processing of their data.


Furthermore, in accordance with Art. 13 para. 2, persons concerned have the right to revoke their consent to the processing of personal data for the future if the processing of data is based on Art. 6 para. 1 a or Art. 9 para. 2 a DSGVO. The legality of the processing of data, carried out on the basis of the consent until revoked, is not affected. However, revocation or failure to provide all necessary data means that the purpose for which the data was or could have been collected cannot be fulfilled. Written form is required to exercise the rights.

Deletion of personal data
Personal data will be deleted if the purpose for storage no longer applies and no legal norm (e.g. for the legal retention period) prescribes the retention of the data. The requirements of Article 17 DSGVO in conjunction with § 35 BDSG apply. If deletion is not possible for legal, contractual, commercial or tax reasons, the processing of the data may be restricted at the request of the person concerned. Written form is required for exercising the right.

 


The right of the person concerned to data transferability
The company guarantees the right to data transferability in accordance with Article 20 DSGVO. Every person concerned has the right to receive a copy of his pb data in a common machine-readable file format.
